Website terms
Clear expectations for everyone who visits DavahCare, asks for support, or applies to offer services.
Scope and who these policies cover
DavahCare provides this website and care partner application service, with a contact address at Matina Crossing, Davao City, Davao del Sur, Philippines. “Client” means an adult arranging support; “care partner” means a person applying for or providing a service. These policies set the rules for website use, application handling, and care standards. The agreement for each service must identify the legal operator, the actual parties, and their respective responsibilities. Employment and agency relationships depend on the actual arrangement and applicable law.
This website provides service information, prepares area enquiry emails, and securely saves care partner applications for administrator review. It does not collect payments, create applicant accounts, show live provider inventory, or confirm a booking. App screens and lifestyle images are illustrative, not evidence of a particular provider’s approval, a completed booking, or a customer endorsement. Read the app’s applicable terms and transaction details before using its services.
Eligibility and accurate information
You must be at least 18 to request services or apply as a care partner. You must have authority to arrange help for another person and provide accurate instructions and contact information. Do not impersonate another person, falsify documents or references, misrepresent skills, or submit someone else’s personal information without a lawful basis.
Acceptable use
Do not misuse the website, introduce malicious code, evade access controls, harass others, submit fraudulent enquiries, or publish private information. Requests for illegal activity, exploitation, sexual services, discrimination, unsafe work, or unlicensed professional work are prohibited. Access or an application may be restricted for credible safety, security, or misuse concerns, with a route to request review at legal@davahcare.com.
Content and intellectual property
The DavahCare name, branding, and original website materials are reserved by their respective rights holders. You may view and share links for lawful personal use. You may not misrepresent affiliation, impersonate DavahCare, or commercially reproduce protected content without permission. You retain rights in material you submit; sending an enquiry does not give DavahCare permission to publish your story, image, or testimonial.
Changes and interpretation
Revisions state their effective date and apply prospectively. Changes do not retrospectively alter an accepted booking without lawful agreement. Mere browsing or silence is not treated as consent to undisclosed charges or new sensitive-data processing. If a provision is invalid, the remaining lawful provisions continue to the extent permitted. Mandatory Philippine law takes priority over conflicting wording.
Back to top ↑Bookings, payments & cancellations
An enquiry is a conversation starter. A booking needs clear, agreed details.
Before confirmation
Before a service is accepted, the client must be given the provider’s identity, the responsible business’s legal identity and contact details, the parties’ respective roles, the task and exclusions, location, date, duration, total charges, payment method, authorised expenses, and cancellation and refund terms. Relevant care plans and handover arrangements must also be agreed. Do not treat a website enquiry, application, or sample app status as confirmation.
Scope, expenses, and changes
A provider must stay within the agreed task and approved skills. Additional hours, purchases, travel, or duties require prior agreement on cost and safety. For shopping or errands, set a spending limit and require receipts. No banking password, card PIN, or one-time code should be shared. This website does not charge a booking fee or collect a deposit.
Cancellation, delay, and missed visits
Request a change or cancellation promptly through the agreed booking channel and preserve the confirmation. Any cancellation or no-show charge must have been clearly disclosed and lawfully accepted before booking. This page does not create a fixed penalty or a blanket “no refunds” rule. Where a provider cancels, does not attend, or cannot complete the agreed work, discuss an appropriate remedy under the accepted agreement and applicable law.
Refunds and disputes
Contact wecare@davahcare.com with the booking reference, date, amount, receipts, and a concise description of the issue. Do not send full card details. Refund eligibility, deductions, method, and timing must follow the disclosed transaction terms and mandatory consumer protections. Reporting a dispute does not prevent you from exercising lawful rights through your payment provider or a competent authority. No internal reporting deadline on this page shortens a statutory right.
Back to top ↑Care, screening & safeguarding
Screening and careful planning are essential. Neither is an absolute guarantee of safety.
Care partner approval requirements
Applicants must be at least 18, eligible to work in the Philippines, and provide identity documents and a valid NBI clearance. DavahCare requires consent-based background and reference checks and review of role-relevant experience before approval. Clearance alone is insufficient. Screening claims and any approval label must reflect checks actually completed; applicants must disclose material changes relevant to suitability and cooperate with proportionate rechecks.
Children and authorised handovers
Only a parent or lawful guardian may arrange child services. Agree the child’s care needs, named authorised adults, pickup permissions, emergency contacts, and handover method before the visit. Verify the assigned partner’s identity and never release a child to an unconfirmed person. School pickup does not itself authorise motor-vehicle transport. Any transport requires a separate lawful arrangement, appropriate driver and vehicle checks, restraints, and applicable coverage.
Older adults and people needing support
Respect the recipient’s dignity, wishes, consent, and decision-making capacity. Obtain appropriate lawful authority where required. Support is limited to non-medical companionship and agreed everyday activities within the provider’s ability. Medication administration, clinical procedures, high-risk lifting, continuous health monitoring, and emergency care are outside the services described here.
Safe homes, pets, and belongings
Clients must disclose relevant hazards, access needs, allergies, aggressive animals, or other risks and provide a safe, respectful work setting. Agree pet handling, feeding, and leash instructions. Restrict keys and access codes to what the visit requires and agree their return or removal. Providers must safeguard entrusted property, respect confidentiality, and avoid unauthorised visitors, recordings, substitutions, or purchases.
When something is unsafe
Either party may stop work that is unsafe, abusive, unlawful, or outside the agreed scope and seek help. Do not leave a child or dependent person without a safe handover. In immediate danger, contact local emergency services first. DavahCare email is not an emergency channel and has no promised round-the-clock monitoring or response time. Report non-emergency concerns to wecare@davahcare.com.
Back to top ↑Privacy & website data
This notice covers website enquiries and care partner applications. Background screening and the mobile app require their own notices reflecting their actual data practices.
Care partner applications
The application form collects your name, email, Philippine mobile number, city or municipality, province, selected services, experience, availability, optional introduction, and eligibility and privacy acknowledgements. A submission reference, time, policy version, and internal review status are also recorded. No attachments, government IDs, exact home address, banking information, or medical records are requested.
When you select “Submit my application”, your answers are sent to DavahCare’s server over HTTPS and saved in a private managed database. Application answers are encrypted before storage, using a key held in server configuration. An authorised administrator can view and decrypt them through a protected session, review your suitability, and contact you about the application. They are not published or made available through a public applicant directory. The site does not send an automatic confirmation email.
Purpose and your choice
The purpose is to assess your expression of interest and discuss application next steps. Your form acknowledgement records your request for this use; it is not permission for advertising or for background checks. Do not include sensitive information or other people’s private details. Initial eligibility declarations are self-reported and are not verification.
Enquiries and security records
The separate area enquiry form prepares a draft in your email app; you choose whether to send it. It does not save an application. Email services process sent messages under their own practices. To limit abuse, the application server stores a keyed, non-plain-text identifier derived from the connection address, request counters, and expiry times. Admin session tokens are random, kept in secure HTTP-only cookies, and stored server-side only as hashes. Sessions expire after eight hours; expired session and rate-limit entries are cleaned up during subsequent intake or login activity.
Technical services and cookies
The host may process IP addresses, device information, and security logs. This site requests fonts from Google Fonts, which receives ordinary connection information. No advertising analytics or tracking cookies are added by the DavahCare page code. The administrator sign-in uses an essential session cookie; applicant answers are not saved in browser storage. The hosting provider’s sign-in or access controls may use essential mechanisms. External email and app-store services have their own notices.
Lawful handling and sensitive information
Under RA 10173, processing must have an appropriate lawful basis and a clear, legitimate, proportionate purpose. Routine requests, legal duties, and any optional consent-based use must be distinguished. Sensitive information, including screening records, needs an applicable legal condition and appropriate safeguards; ordinary enquiry consent is not blanket authorisation for background checks. A separate notice and secure collection process are required before screening or care-related sensitive data is requested.
Sharing, safeguards, and retention
Applicant information is intended only for the authorised reviewer and the hosting and database processors needed to provide this service, or disclosures required by law. Hosting uses Cloudflare-based infrastructure; processing may take place outside the Philippines. Access controls, encryption of application answers, server-side input validation, and sign-in limits reduce risk but do not eliminate it. Passwords and encryption keys are not included in public website files.
Applications are retained while needed to assess the application, communicate with the applicant, resolve a related concern, or meet a lawful retention obligation. Authorised administrators are responsible for reviewing continued necessity and deleting records when those purposes end; deletion is managed by the team, not an automatic expiry. You may request correction or deletion through legal@davahcare.com. Deletion removes the application from the active database; residual copies may remain within the hosting provider’s backup lifecycle, subject to its safeguards.
Your choices and rights
Subject to applicable conditions, you may request information, access, correction, erasure or blocking, object to processing, withdraw consent, or exercise data portability rights. You may complain to the National Privacy Commission. Send privacy enquiries to legal@davahcare.com; proportionate identity verification may be necessary. Do not send identity documents until a secure method is agreed. A deletion request does not override a lawful duty to retain a particular record.
DavahCare privacy contact
DavahCare is responsible for handling the website enquiries and care partner applications described in this notice. Address privacy requests to DavahCare, Matina Crossing, Davao City, Davao del Sur, Philippines, or email legal@davahcare.com. Include your application reference where available and the request you would like us to review. Contact us by email first to arrange any in-person assistance.
Back to top ↑Care partner & fair work standards
Flexible work must still be respectful, safe, and lawful.
Applying and offering services
An application is subject to screening and role approval and is not a job offer, guaranteed income, or promise of hours. Providers must truthfully describe their skills, work only within their approved scope, observe agreed care instructions, and raise concerns when a task is unsuitable. Credentials and client information must not be shared unnecessarily.
Actual arrangements determine obligations
A “care partner”, “part-time”, or “independent” label does not determine employment status. The real arrangement and applicable law govern. Where an employment relationship exists, applicable wages, rest, statutory benefits, social protection, and other labour rights must be respected. RA 10361 covers domestic work within an employment relationship and excludes specified occasional or sporadic work not done on an occupational basis; short bookings alone do not settle that distinction.
Written expectations and decent treatment
Agree duties, pay, hours, expenses, and relevant rest arrangements before work. No forced labour, harassment, discrimination, unsafe work, or withholding of identity documents is acceptable. Clients and providers should use the complaints contact without threats or retaliation for good-faith reports. Any employer, recruitment, placement, or platform duties must be allocated in a lawful agreement reflecting the actual operating model.
DavahCare’s fair work commitments do not replace applicable employer, recruitment, or placement obligations. Any authorisations required for the actual service arrangement must be in place before that activity is carried out. DavahCare does not represent government accreditation or exemption from labour requirements.
Back to top ↑Responsibilities & service limits
Each party remains accountable for the responsibilities the law and the agreed service place on them.
What is not promised
DavahCare does not guarantee uninterrupted website access, universal service coverage, a specific provider’s future conduct, complete risk elimination, or a particular result. Background checks cannot reveal every risk. No insurance, bond, compensation fund, professional licence, or government endorsement is represented unless supported by specific, verifiable terms. Do not assume a booking or the word “verified” includes insurance.
Lawful responsibility
Responsibility for loss depends on the facts, the parties’ duties, causation, and applicable law. These policies do not automatically shift all risk to a client or provider, exclude responsibility for DavahCare’s own legally actionable conduct, or create unlimited reimbursement duties. There is no blanket waiver for injury, property loss, privacy violations, fraud, or other liabilities that cannot lawfully be excluded.
Mandatory consumer, labour, privacy, and other statutory protections continue to apply, including any platform responsibilities under the Internet Transactions Act where applicable. Nothing waives an action for future fraud. A separate service agreement cannot override non-waivable rights merely by referring to this website.
Events outside reasonable control
Severe weather, disasters, official restrictions, or infrastructure failures may disrupt a visit. Notify the other party promptly and agree a safe cancellation or rescheduling plan. Such events do not automatically remove refund duties, reasonable care obligations, or responsibility imposed by law.
Future robot-care vision
The robot-care section is an aspiration, not a current service, sale offer, medical claim, or release commitment. Its imagery is conceptual. No robotic supervision, continuous monitoring, emergency detection, or substitute for responsible human care is promised. Any future deployment would need separate terms, safety assessment, appropriate oversight, privacy choices, and applicable approvals.

Our address and regional support
DavahCare
Matina Crossing, Davao City, Davao del Sur, Philippines.
Regional offices are planned in selected Philippine regions and cities to assist care partners and receive service concerns and complaints. Confirmed locations, opening hours, and contact arrangements will be published before each office opens. Until then, use the email contacts above. Please email first to confirm arrangements before visiting or sending physical correspondence.
What to include
Send your name, a reply contact, the relevant reference and dates, a concise factual description, and the remedy you seek. Preserve relevant messages and receipts. Share only information needed to explain the issue and ask for a secure method before supplying sensitive evidence. Do not post another person’s private details publicly or send complete payment credentials.
Review and escalation
Ask for acknowledgement and a case reference when reporting a concern. Further information may be requested to assess the facts and an appropriate remedy. An email submission does not itself confirm receipt, resolution, compensation, or a response deadline. In an urgent safety situation, contact emergency services directly.
Using this process does not restrict access to competent courts, law enforcement, DOLE, the National Privacy Commission, DTI, or other authorities. Where applicable, consumer complaints can be submitted through the DTI Consumer CARe system. Philippine law governs subject to mandatory jurisdiction and consumer protections; no exclusive venue or compulsory arbitration is imposed by these policies.
